A

Agreement for Sale Legal
A legally binding document between the buyer and seller that outlines the terms and conditions of the property sale, including price, payment schedule, and possession date. It is signed before the final Sale Deed and must be registered under MahaRERA for under-construction properties. The Agreement for Sale is the primary document establishing the buyer's rights.
Allotment Letter Documentation
An official document issued by the developer confirming that a specific unit (apartment, plot, or villa) has been allotted to a buyer. It mentions the unit number, floor, configuration, and agreed price. It is the first formal document in the purchase process and precedes the Agreement for Sale.
Amenities Project
Facilities and features provided within a housing project, such as swimming pool, clubhouse, gymnasium, playground, and landscaped gardens. Under RERA, all amenities advertised must be delivered. Forest Trails offers 60+ amenities including The Cliff Club, equestrian academy, and nature trails — all RERA registered.
B

Bhogavata Revenue Record
A Marathi term used in property records meaning 'enjoyment' or 'occupancy rights.' A property's Bhogavata certificate or entry confirms who currently occupies and enjoys the property. It is part of the 7/12 extract in Maharashtra and is relevant for verifying actual possession vs. paper ownership.
Built-up Area Area Measurement
The total area of an apartment including the carpet area plus the thickness of external walls and the area of the balcony. Built-up area is typically 10–15% more than carpet area. This is different from Super Built-up Area, which additionally includes common areas like lobbies, staircases, and lifts.
BHK (Bedroom-Hall-Kitchen) Configuration
Stands for Bedroom-Hall-Kitchen. It denotes the configuration of an apartment. 2-BHK means 2 bedrooms + 1 living hall + 1 kitchen. Forest Trails offers 2-BHK and 3-BHK in The Canopy and The Highgardens, and 4–5 BHK villas in The Rivolo.
C

Carpet Area RERA Defined
As defined under RERA, carpet area is the net usable floor area of an apartment excluding the thickness of external walls, balconies, verandahs, and common areas. RERA mandates that all apartments must be sold on carpet area basis. For Forest Trails apartments, carpet area is typically 70–75% of the super built-up area. ⚠️ Always verify carpet area on your RERA registration documents.
CC (Completion Certificate) Authority Document
A document issued by the local authority (PMRDA for Bhugaon) certifying that the construction of a building has been completed as per approved plans. Possession should ideally only be given after obtaining CC. Do not confuse with OC (Occupancy Certificate) — see below. CC comes before OC in the sequence.
Conveyance Deed Legal
The final legal document that transfers absolute ownership (title) of a property from the developer/seller to the buyer. It is executed after full payment and is registered at the Sub-Registrar's office. Also called Sale Deed for most purposes. The Conveyance Deed is the strongest proof of legal ownership.
D

Development Agreement Legal
A contract between the landowner and the developer giving the developer the right to develop the land. The developer constructs and sells units in exchange for a share of units or revenue. Understanding the development agreement is important for title verification as it forms the basis of the developer's right to sell.
Deemed Conveyance Maharashtra Law
Under Maharashtra law, if a developer delays the transfer of land title (conveyance) to a registered housing society, residents can approach the District Deputy Registrar for 'deemed conveyance' — a forced transfer of title. Relevant for apartment buyers who form a cooperative housing society after possession.
E

Encumbrance Certificate Title Search
A certificate issued by the Sub-Registrar's office listing all financial and legal liabilities (mortgages, loans, liens, court orders) registered against a property. An encumbrance-free certificate is essential before purchasing any resale property. In Maharashtra, this information is available through the Index II document.
EMI (Equated Monthly Instalment) Finance
The fixed monthly payment made to a bank or financial institution towards repayment of a home loan. EMI comprises two parts: principal repayment and interest. For a ₹1.23 Cr* plot loan at 9.25% for 20 years, EMI is approximately ₹79,500*. Use our calculator for your specific scenario.
F

FEMA (Foreign Exchange Management Act) NRI
The law governing foreign exchange transactions in India, relevant for NRI property purchases. Under FEMA, NRIs and OCIs can purchase residential and commercial properties in India (but not agricultural land, plantation property, or farmhouses) using funds in NRE/NRO accounts. All property transactions must comply with FEMA guidelines.
FSI / FAR (Floor Space Index / Floor Area Ratio) Planning
A planning regulation that defines the maximum total floor area that can be built on a plot of land relative to the plot's area. An FSI of 1.5 means you can build 1.5 times the plot area as total floor space. FSI determines the number of floors and density of a project — critical for understanding a project's development potential.
G

GPA (General Power of Attorney) Legal / NRI
A legal document authorizing a person to act on behalf of another in property-related matters, including buying, selling, registering, and managing property. GPA is commonly used by NRIs to authorize a local representative. However, GPA-based property sales were restricted post-2011 Supreme Court ruling — registration must happen in the principal's name.
H

HRERA (Haryana RERA) Context
Haryana Real Estate Regulatory Authority — the state RERA for Haryana. Mentioned for context as Maharashtra's equivalent is MahaRERA (Maharashtra Real Estate Regulatory Authority). Both operate under the same central RERA Act 2016 but have state-specific rules. MahaRERA is considered one of India's most active and buyer-friendly RERA authorities.
I

Index II Maharashtra Record
A document from the Sub-Registrar's office (Maharashtra) that records every transaction and encumbrance registered against a property. Checking Index II going back 30 years is part of a thorough title search. Available online at igrmaharashtra.gov.in.
IOD (Intimation of Disapproval) Building Permission
Technically IOD is a permission granted by the local municipal authority/PMRDA to start construction, after approving the building plans. It is a prerequisite to beginning construction work. IOD is followed by CC (Completion Certificate) after construction is complete. ⚠️ Name is confusing — 'disapproval' refers to disapproving any deviations, not the project.
J

Joint Development Agreement (JDA) Developer
An agreement between a landowner and developer where the landowner provides land and the developer constructs a project. The revenue/units are shared as per a pre-agreed ratio. Many large residential projects in Pune are executed under JDA arrangements. Understanding JDA is important for title verification and understanding the developer's rights.
K

Khata Karnataka Equivalent
Used primarily in Karnataka (Bangalore) for property tax records. In Maharashtra, the equivalent is property card or 7/12 extract. A Khata certificate in Karnataka establishes the owner's right to pay property tax and build. Maharashtra buyers should look for the 7/12 extract (Satbara Utara) instead of a Khata.
L

Land Use Certificate Revenue
A certificate from the local planning authority confirming the approved land use (residential, commercial, agricultural, industrial) for a plot. For NA plots, the NA Order itself serves as this certificate, confirming the land is approved for non-agricultural residential use. Essential before purchasing any plot.
Letter of Intent (LOI) Documentation
A document expressing a buyer's serious intention to purchase a property. It typically precedes the Agreement for Sale and outlines the key deal terms. Some developers issue an Allotment Letter as the functional equivalent of LOI. The LOI is not legally binding in the same way as an Agreement for Sale.
M

MahaRERA Regulatory
Maharashtra Real Estate Regulatory Authority — the regulatory body overseeing real estate in Maharashtra under the RERA Act 2016. All residential projects above 500 sq.mt or 8 apartments must be registered with MahaRERA. Buyers can verify project registration, check construction updates, and file complaints at maharera.mahaonline.gov.in. Forest Trails RERA: P52100053834.
Mutation Revenue
The process of updating the official government land records (property card / 7/12 extract) to reflect a change in ownership. After purchasing a property, the buyer must apply for mutation at the local revenue office to update the records in their name. Mutation must be completed for the ownership to be legally reflected in government records.
Mortgage Finance
A loan secured against a property as collateral. The property is 'mortgaged' to the bank until the loan is fully repaid. If the borrower defaults, the bank can take possession and sell the property to recover the loan. Always check if a resale property is free from mortgage using the Encumbrance Certificate.
N

NA Order (Non-Agricultural Order) Critical for Plots
An order from the Collector/revenue authorities converting agricultural land to non-agricultural (residential/commercial) use. NA order is a critical document for plot buyers — Misty Greens plots have valid NA orders, ensuring buyers can legally construct homes. Without an NA order, construction on agricultural land is illegal and structures may be demolished.
NOC (No Objection Certificate) Compliance
A certificate from various authorities (fire department, environmental authority, water board, electricity board) confirming they have no objection to a construction project. Multiple NOCs are required before a project can receive OC. Buyers should verify that their project has obtained all required NOCs.
NRI Property Rules NRI
Non-Resident Indians (NRIs) and Overseas Citizens of India (OCIs) can buy residential and commercial properties in India without RBI permission. They cannot buy agricultural land, plantation property, or farmhouses. Payments must be in Indian Rupees through NRE/NRO accounts. Rental income can be repatriated; sale proceeds can be repatriated for up to 2 properties.
O

OC (Occupancy Certificate) Critical
Issued by the local authority (PMRDA for Bhugaon) certifying that the building is safe for occupation and has been built per approved plans. OC is mandatory before a builder can legally give possession of an apartment. Buyers should insist on OC before taking possession. Without OC, utility connections may be affected and the occupancy is technically illegal.
Open Plot Plot Type
An NA-converted, demarcated, and registered residential plot without any construction. Misty Greens at Forest Trails offers open NA plots. Buyers can construct their own custom home as per PMRDA building guidelines (within allowable FSI). Open plots offer maximum customization including Vaastu design freedom.
P

Possession Letter Documentation
A formal letter from the developer informing the buyer that the unit is ready for possession and handover. It mentions the possession date, snag inspection process, and any pending payments. After receiving the possession letter, the buyer does a final walk-through before signing the possession receipt. Ensure OC is obtained before accepting possession.
POA (Power of Attorney) Legal / NRI
A legal document authorizing a person (attorney) to act on behalf of the principal in specific legal matters. POA is essential for NRI buyers who cannot be physically present for registration. Note: POA must be authenticated/attested by the Indian Embassy in the country of residence before it is valid in India.
PMC (Pune Municipal Corporation) Governance
Pune's main municipal body covering the core Pune city area. Bhugaon and Forest Trails fall under PMRDA jurisdiction, not PMC, which has implications for property taxes (lower in PMRDA), building approvals (PMRDA processes), and stamp duty calculations. Do not use PMC references when researching Forest Trails.
PMRDA (Pune Metropolitan Region Development Authority) Governance
The planning authority for the Pune Metropolitan Region outside PMC limits. Bhugaon and Forest Trails fall under PMRDA. PMRDA approves building plans, issues OC/CC, collects property taxes, and oversees planned development in the Pune Metropolitan Region. PMRDA website: pmrda.gov.in.
R

RERA (Real Estate Regulatory Authority) Regulatory
A regulatory framework established under the Real Estate (Regulation and Development) Act, 2016 to protect homebuyers and regulate the real estate sector. RERA mandates project registration, escrow of 70% of funds, defined possession timelines, and penalties for delays. Maharashtra's authority is MahaRERA. Forest Trails RERA registrations: P52100053834 | P52100031560 | P52100048536 | P52100079518.
Registration Charges Tax / Fee
The fee paid to register a property document (Agreement for Sale, Sale Deed) with the Sub-Registrar. In Maharashtra, registration charges are 1% of the property value for properties above ₹30 Lakhs*. This is separate from stamp duty and must be paid additionally. Registration charges are subject to revision — verify current rates at igrmaharashtra.gov.in.
Ready Reckoner Rate Valuation
The minimum value set by the Maharashtra government (Revenue Department) for property transactions in each area. Stamp duty and registration charges are calculated on the higher of the actual transaction price or the Ready Reckoner (RR) rate. RR rates are updated annually. Check current Bhugaon rates at igrmaharashtra.gov.in.
S

Sale Deed Legal
The final, legally binding document that transfers ownership of a property from seller to buyer. Executed after full payment, the Sale Deed must be registered at the Sub-Registrar's office after payment of stamp duty. It is the conclusive proof of ownership. Ensure the Sale Deed includes all specifications, amenities, and agreed terms.
Stamp Duty Tax
A government tax paid when registering a property transaction. In Maharashtra, stamp duty is 5% for men buyers and 4% for women buyers*. For Bhugaon (PMRDA area), additional local body tax may apply. Stamp duty must be paid via Government Receipt Accounting System (GRAS) before registration. Use our Stamp Duty Calculator for exact figures.
Super Built-up Area (SBA) Area Measurement
The total area including carpet area + walls + proportionate share of common areas (lobby, staircase, lift, clubhouse, etc.). Developers often quote prices on SBA, which inflates the price-per-sqft. RERA now requires prices to be quoted on carpet area basis — always ask for carpet area price when comparing properties.
Survey Number Revenue
A unique identification number assigned to each parcel of land in government revenue records. The survey number appears on the 7/12 extract, sale deed, and development permission documents. It is used to uniquely identify a piece of land — always verify that the survey number on the sale deed matches the actual land being purchased.
T

Title Search Due Diligence
A thorough examination of all historical records related to a property to confirm the seller has a clear, marketable title free from encumbrances, disputes, and third-party claims. A title search covers at least 30 years of records including 7/12 extract, mutation records, encumbrance certificate, and court records. Always engage a qualified property lawyer for title search.
Transfer of Ownership Legal
The legal process of moving property rights from one party to another, typically through a Sale Deed registered at the Sub-Registrar's office. For cooperative housing societies, ownership transfer must also be recorded in the society's share certificate. For plots, mutation of revenue records is essential after transfer.
TDS on Property (Section 194-IA) Tax
Under Section 194-IA of the Income Tax Act, if the property value exceeds ₹50 Lakhs*, the buyer must deduct TDS at 1% of the sale consideration and deposit it with the government. For NRI sellers, the TDS rate is 20% for Long-Term Capital Gains. The buyer must file Form 26QB and issue Form 16B to the seller.
U

Undivided Share (UDS) Apartment Ownership
In apartment complexes, the proportionate share of the land that belongs to each apartment owner is called the Undivided Share. Even though individual apartment owners cannot physically separate their land share, UDS gives them legal ownership in the land. UDS is mentioned in the Sale Deed and is a key component of apartment ownership.
Urban Land Ceiling Historical Context
The Urban Land (Ceiling and Regulation) Act was repealed in most states including Maharashtra. It had restricted private ownership of urban land above a certain ceiling. Post-repeal, land can be consolidated for township development — relevant context for understanding how large integrated developments like Forest Trails (190 acres) are legally assembled.
V

Valuation Certificate Finance
A document from a registered property valuer (approved by the government) estimating the fair market value of a property. Banks require valuation certificates before sanctioning home loans. For stamp duty purposes, the government's Ready Reckoner rate serves as the valuation benchmark. Get valuation from a bank-empanelled valuer.
Vaastu Shastra Design
Ancient Indian science of architecture based on directional alignment to promote wellbeing and prosperity. Many Indian home buyers, especially for independent plots and villas, consider Vaastu compliance important. Misty Greens plots allow buyers complete freedom to design Vaastu-compliant homes — a key advantage over fixed-plan apartments.
7/12

7/12 Extract (Satbara Utara) Most Important
The most important land record document in Maharashtra. Named after Sections 7 and 12 of the Maharashtra Land Revenue Code. The 7/12 extract contains:
  • Survey number and sub-division
  • Total area of the plot
  • Land type (NA/agricultural/government)
  • Owner's name and co-owner details
  • Nature of possession (Bhogavata)
  • Cultivation details
  • Encumbrances (mortgages, attachments)
Every NA plot transaction requires verification of the 7/12 extract. Available online at bhulekh.mahabhumi.gov.in. For Misty Greens plots, the 7/12 extract shows NA conversion and Paranjape Schemes as the registered title holder.

⚡ 5 Common Confusions — Solved

Carpet area is the net usable area inside your apartment (excluding walls, balconies, and common spaces). Super built-up area includes carpet area + wall thickness + your proportionate share of common areas like lobby, lift, staircase, and amenity spaces. RERA mandates that prices be quoted on carpet area. Typically, carpet area is 65–75% of super built-up area for apartments.

CC (Completion Certificate) is issued by the authority when construction is complete as per sanctioned plans. OC (Occupancy Certificate) is issued after the authority inspects the completed building and certifies it is safe for occupation. OC is more comprehensive than CC and is required before legal possession can be given to buyers. Always insist on OC — not just CC — before taking possession.

Bhugaon and Paranjape Forest Trails fall under the jurisdiction of PMRDA (Pune Metropolitan Region Development Authority), not PMC (Pune Municipal Corporation). This matters for property taxes, building approvals, and stamp duty rates. PMRDA areas typically have lower property taxes than PMC areas — a cost advantage for Forest Trails buyers.

A home loan is taken to buy a built property (apartment, house) or construct on an existing plot. A plot loan is specifically for purchasing a residential plot. Plot loans have higher interest rates (0.25–0.5% more), lower LTV (70% vs 80–85%), and cannot include construction costs. A separate construction loan must be taken for building. Some banks offer a combined plot + construction loan product.

Yes, construction of residential buildings requires the plot to have a Non-Agricultural (NA) order from the District Collector converting the land use from agricultural to residential. All Misty Greens plots at Forest Trails have valid NA orders, making them fully legal for residential construction under PMRDA building regulations. Always verify NA order status before purchasing any plot.
